Licence Agreement for modding in “Cassette Beasts”

These terms set out the basis upon which Bytten Studio Limited, as developers of the game “Cassette Beasts” (“Game”), will allow players to create mods for the Game and to upload the mods to the Steam Workshop and/or ModWorkshop ("Workshop") pages. Those mods would be capable of being downloaded by other players for use in the Game.

By creating a mod for the Game:

  1. you are agreeing to abide by these Licence terms; and
  2. you acknowledge that the User Generated Content section of the Steam Subscriber Agreement also applies to mods you publish on the Steam Workshop, except that this Licence will override that User Generated Content section where there might be differences.

In this licence, we will use the term “Modders” for anyone who creates a mod and uploads it to the Workshop, for download by other players.

You acknowledge that all intellectual property rights in the Game and the Game’s content (excluding mods) either belong to us or have been licensed to us and that any intellectual property rights in the Game and its content (including mods created by other Modders), are merely licensed to you and are therefore not transferred/sold to you. Mods should therefore not be a copy of any Game content and the ability to create mods does not permit distribution of Cassette Beasts in binary or decompiled form.

Mods made by you are your creation but please note that we are under no obligation to assist you in their creation nor to make the Game compatible with your mod. Any mods that you create shall belong to you but only to the extent that the mod contains your original creative work. We do not claim any ownership of any mods made. Other than making your mod available within the Game or except with your permission, Bytten Studio will not exploit your mod in any way.

When you upload a mod to the Workshop, you are giving us permission to include the mod in the Game. However, we will not take ownership of your mod, merely a licence to include it in the Game for so long as the Game or modding support is available (both of which are up to us or our publisher). We do not give any guarantees as to how long the Game will be available.

The inclusion of any mods in the Game will not entitle you to any payment from us.

Rules for modding in Cassette Beasts

We have put in place the following rules (“Rules”) for modding so that it remains a fair and fun feature within the Game:

  1. Any mod must be original and must be your creation and, except where paragraph 3 below might apply, should not contain any third party’s content nor should it have any resemblance to any recognisable third party brand or character (including but not limited to any trademark or logos) or a personality. You should not copy someone else’s property when making a mod nor should you copy someone else’s mod and take credit for it. If you are going to make a submod, you should contact the original Modder to notify them in advance. We reserve the right to contact brand or character owners to verify that they have either created and uploaded the mod or given permission for the content to be contained within a mod and if we discover that they have not created the mod in question or otherwise given permission, we will delete it.
  2. You are not to monetise the mods themselves for use in the Game, for example by way of receiving payment for the creation of or download of mods or using a mod to advertise some other product or service. Therefore, the reference in the Steam Subscriber Agreement at clause 6(B) to mods possibly being for purchase as a “Workshop Contribution” (as defined in the Steam Subscriber Agreement) does not apply here as mods created for the Game are not to be made available in exchange for money. As the creator of a mod, however, we would not prevent you:
    • from monetising the original parts of your mod outside of the Game, for example an original music track created and published in a Cassette Beasts mod could itself be placed for sale on a music platform; or
    • from, for example, taking an original monster or character you have created for a mod and including just that monster, character or other art assets you have created in a commercial video game that you may develop or placing it on a t-shirt and selling that (for example). However, the mod itself should not be monetised. Please remember that the content of mods created by modders will be their property and so if you are not the creator of a particular mod or assets within a mod, you should not use a mod or other assets as if they are yours. We are not responsible or liable for your use of a mod or its content outside of the Game.
  3. If you are a game developer you may include a character from a game you have developed within a mod in the Game (but at no cost to players) but please note that this is strictly limited to other game developers creating such a mod and the modder must have the permission of the developer to do this. We reserve the right to contact character owners to verify that they have permitted the content and if we discover that they have not so given permission, we will delete it.
  4. We are only permitting the creation and upload of mods. You are not to distribute our Game in any way, whether in binary or decompiled form or otherwise.
  5. You are not to introduce mods that harm either us as the developers, the Game or other people in any way and therefore you are not to create any mods that could be: personal or private to you or anyone else; harmful or capable of causing harm; based on someone else’s intellectual property; offensive, derogatory, sexist, racist, defamatory or that are similarly objectionable or damaging to our goodwill.
  6. You are not to include any content within your mod that has been created by generative artificial intelligence.
  7. You are not to introduce any virus or malware (of any description whatsoever), griefing tools or denial of service tools in mods that you may create, nor should the mod have the effect of in any way damaging or interfering with the operation of the Game.
  8. You are not to use the Cassette Beasts multiplayer servers for any games other than Cassette Beasts but reasonable use by mods for Cassette Beasts is allowed.

You are not to make any public disclosure of any security issues that you may encounter until 3 months after informing Bytten Studio of the issue by email at contact@bytten-studio.com

You should ensure that your mods and the modding itself follow not only the Rules as stated but also the spirit of the Rules.

We are not responsible for moderating or monitoring any mods created but we reserve the right to do so. We do not endorse any mods created. If we choose to so moderate or monitor, we may intervene in respect of any mod to ensure it complies with this Licence and the Rules. If we consider there is a breach of this Licence or the Rules, we reserve the right to (whether by ourselves or with the assistance of Valve or ModWorkshop moderators), without limitation, make any mod invisible and then contact the Modder to require alterations to be made and re-uploaded once corrected (the invisibility of the mod only being lifted when we are satisfied with the changes) or delete a mod if we consider that to be  appropriate or if the Modder does not alter a mod to our satisfaction after being requested to do so. We can take any of these actions with or without notice to you and we will not be liable to make any compensation payment to you if we suspend or remove a mod you have created.

You, as the creator of a mod, agree to indemnify, defend and hold us (including our officers, directors, employees and agents) harmless from any damages, losses, cost and expenses (including legal costs and expenses) arising directly or indirectly out of the creation of a mod by you, including but not limited to any allegation that the mod breaches the copyright, trademark, privacy or other intellectual property or other rights of any third party, or any other breach by you of this Licence and its terms.

The provisions and part-provisions of this Licence operate separately. If any court or relevant authority decides that any of them or any part of them are unlawful, the remaining provisions will remain in full force and effect.

Nothing in this Licence gives or claims to give to any third party any benefit or right to enforce any term of this Licence, and the provisions of the Contracts (Rights of Third Parties) Act 1999 (as amended or modified from time to time) are expressly excluded.

This Licence shall be construed under laws of England and Wales, and you consent to the exclusive jurisdiction of the English Courts.

We may amend the terms of this Licence from time to time. Please check these terms regularly to ensure you understand the terms that apply from time to time.
